1. Scope

1.1 For the business connection between Garn Store www.garn-store.com
Owner:
Anja Diewald, Gertrudenstrasse 21, 50667 Cologne (following sales assistant) and the customer (following customer) apply only the following terms and conditions vald at the time of order.

1.3.
Within these terms is any natural person who enters into a transaction for a purpose that can be attributed
mostly neither commercial nor its independent professional activity (§ 13 BGB).
Employer is any natural or legal person or a legal partnership, in concluding a legal transaction in the
exercise of its independent professional or commercial activity.

1.4. Different conditions of the customer are not recognised, unless the sales assistant agrees to them
explicity.

1.5. Contract language is German. The contract will be stored by the sales assistant. The storage is only
temporary, the customer has therefore to provide for the expression or a seperate storage.  

2. Offers and specifications
2.1. Subject of the contract is the sale of products. The details, especially the essential characteristics of the
products can be found in the item description and product information can be found on the website 
www.dropsgarne.com.
2.2. The presentation of the products in our online shop is not a legally binding offer, but an invitation to 
make an order. Specifications in catalogues and on websites of the sales assistant do not have the 
character of representation or warranty.
2.3. All offers are only available while stock lasts, if not stated otherwise on the products. Incidentially errors
excepted. 


3. Ordering process and contract conclusion
3.1. The customer can choose on the website from the range of products the sale assistant suggested and 
collect these due to the "add to basket" button into a so-called basket. Then the customer can "proceed to
checkout" within the shopping cart by clicking the button at the end of the ordering process. The customer
can also order by phone, in writing, by emailor fax. 
3.2. With clicking the "buy" button, the customer when ordering through the online shop a binding offer to 
purchase the products in the basket. Before submitting the order, the customer can change the data at any
time and understand. Required fields are marked with a asterisk (*). Orders in other ways will be effective
with sending the order and the reception (phone).
3.3. The sale assistant then sends the customer an automatic confirmation of receipt by e-mail, in which the
customers order is listed again and the customer can print the order via the "print" function. The automatic
confirmation of receipt only documents that the customer's order has been received by the sale assistant
and does not constitute acceptance of the request. The purchase contract is only concluded when the sale
assistant will ship within two days to the customer, passing or sending to has customers confirmed within
two days with a second e-mail express order confirmation or sending the invoice.
The contract is subject of a revocation by the customer, concluded when the customer receives a supply of
its ordern. The completion of the order and the transfer of all necessary information take place by a partially
automatic e-mail. The customer must therefore ensure that the stored  e-mail adresse at the sale assistant is
correct, that the receiving of e-mails is technically assured and especially not inhibited by Spam filters.
3.4. Should the sale assistant provide advance payment, the contract is the provision of banking details 
and payment. If the payment is not received in spite of maturity even after the second notice to a time of
ten calendar days after sending the order confirmation with the sale assistant, the sale assistant cancels the
contract back with the result that the order has lapsed and the sale assistant no delivery obligation applies.
The order is then done for the buyer and sale assistant with no consequences. Therefore, a reservation of
the article in advance payments are for maximum of ten calendar days. 

4. Price and shipping charges 
4.1. All prices are listed on the sale assistant's website, are inclusive of applicable taxes in Germany.
4.2.  For commercial customers, there are special conditions. Please ask for the contactform. 
4.3. In addition to the prices charged to the sale assistant for delivery shipping. The shipping costs are 
communicated to the buyer clearly on a separate information page and during the order process.
4.4. For customers from abroad separat fees may apply such as bank charges. These are to be payed by 
the customer.

5. Delivery and product availability 
5.1. Unless advanced payment is agreed, delivery is made after the receipt of the invoice.
5.2. Should not all ordered products be in stock, the sale assistant ist entitled to make partial deliveries at its
own expense, as far as resonable for the customer. 
5.3. Should the delivery of the products due to the fault of the buyer fail after three attempts of delivery, the 
sale assistant can withdraw from the contract. If necessary payments will be refunded to the customer im-
mediately. 
5.4. If the ordered product is not available, because the sale assistant with this product is not supplied by its
supplier, without any fault, the sale assistant can withdraw from the contract. In this case the sale assistant
will inform the customer immediately and suggest to supply a comparable product. If no comparable products
are available or if the customer does not wish to supply a comparable product, the sale assistant will possible 
already reimbursed to the customer immediately money is payed.
5.5. Customers will be informed of delivery times and delivery restrictions (for example, limiting supplies to 
certain countries) on a separate information page or within the product description.

6. Method of payment
6.1. The customer may under and before completing the ordering process choose from the available payment
methods. Customers will be notified of the available payment methods on a different information page. 
6.2. Is the payment by invoice, payment must be made within 14 days after receipt of products and bill. For all
other payment methods, prepayment will be made without decution. 
6.3. Will third-party be resonsible for payment proceeding, e.g. Paypal, their terms apply.
6.4. If the due date of the payment determined by the calendar, so the customer is already through observance
of the event in default interest. 
6.5. The customer's obligation of to pay default interest includes the assertion of further damage caused by 
delay by the sale assistant is not enough.
6.6. A right to offset the customer only is counterclaims are legally established or recognised by the sale
assistant. The customer can only exercise a lien, if the claims from the same contractual relationship.

7. Reservation of ownership
7.1. Until the payment is full filled, the delivered products remain the property of the sale assistant. 

8. Liability of defects and gurantee
8.1. The Liability of defects shall be governed by law provisions.
8.2. The gurantee only applies to the products only if it has been expressly stated. 
8.3. The customer is asked as a customer, to check the products immediately upon delivery for completeness, obvious defects and damage and to communicate complaints to the sale assistans as soon as possible. The liability of defects claims of the customers remain unaffected. If the customer is the consumer, the risk of accidential loss and accidential deterioation of the sold during shipment is not transfered until the transfer of the products by the transporter responsible to the customer, regardless whether the shipment is insured or not. If the customer is not a consumer, supply and shipment is done at his own risk.
8.4. If the customer is an entrepreneur and notwithstanding
8.5. Characteristics of the products are only the sale assistant's and the manufacturer's  product description, the self-reported as agreed, but no other advertising, promotions and public statements by the manufactuer. The customer is oblieged to inspect the products immediately and with the due to attention to the quality and quantity, and within seven days indicate receipt of the products to the sale assistant in writing, the deadline, the timely dispatch is sufficient. This also applies to later found hidden defects from discovery. In case of violation of investigation and reprimand the assertion of the gurantee claim is excluded. In case of defects the sale assistant shall provide at its options by repair or replacement. If the repair fails twice, the customer can demand reduction or withdraw from the contract at his discretion. In case of repair, the sale assistant does not have to bear the increased costs incurred by shipment of the products to a place other than the place, provided that the shipment does not comply with the intended of the products. The gurantee is one year from date of delivery. 

9. Liability
9.1. For the sale assistant's liability for damages without prejudice to other statutory entitlement requirements are the following exclutions or limitations.
9.2. The sale assistant is fully liable if the damage is caused by intent or gross negligence. 
9.3. Furthermore, the sale asisstant is liable for the negligent brent of obligations, which endangers the purpose of the contract, or for the vioaltion of obligations, the fullfilment of which renders a correct execution of the contract and on whose observance the customer regularly relies. In this case, however the sale assistant is liable only for the forseeable, typically damage. The sale assistant is not liable for the negligent breach other than those mentioned in the preceding sentences obligations.
9.4. The above limitations shall not apply to injury to life, body and health, for defect after assumption of a gurantee for the quality of the product and fraudulently concealed defects. Liabilty under the product liability act remains unaffected. 
9.5. If the liabilty of the sale assistant is excluded or limited, this also applies to the personal liability of employees, representatives and agents.
9.6. The data communication via Internet cannot guranteed errors fees and/or available at any time after the currant state of technology. The sale assistant is liable to the extent either for the continuous uninterrupted availbility nor the website and the service offered there. 

10. Storage of contract 
10.1. The customer can print the contract before submitting the order to the sale assistant by using the print function of their browser in the last step of the order.
10.2. The sale assistant also sends the customer an order confirmation with all order data to the e-mail adress provided by him. With the order confirmation, the customer receives further a copy of the Terms of Use and in addition to the instructions about shipping and delivery and payment. If you have registered with us, you can view your orders placed in your profil area. In addition, we save the contract, but not make it available on the internet. 

11. Data protection
11.1. The sale assistant shall process personal data of the customer for appropriate purposes and according to legal regulations. 
11.2. The for the purpose of ordering products specified personal information (such as name, e-mail adress, adress, payment data) are used by the sale assistant for the processing of the contract. This data will be kept confidential and not disclosed to third parties who are not involved in the ordering, delivery and payment procedures. 
11.3. The customer has the right to information free of charge to get over the personal that have been stored by the sale assistant about him. In addition, he has the right to correct inaccurate data, insofar as there is no legal obligation to retain.

12. Jurisdiction, applicable law, contract language
12.1. Jurisdiction and performance is the location of the sale assistant, if the customer is a merchant legal entity under public law or public law special fund. The same applies if the customer has no general jurisdiction in Germany or the EU or the domicil or habitual residence is not begannt in the time action. The authority also do appeal to court in another jurisdiction remains unaffected.
